Positive Mediation

Major conflicts hamper productivity as they waste time, money, and energy. Of course, many such issues are solved via litigation; however, this is a slow, expensive, and indirect process.

Mediation is an alternative dispute resolution (ADR) methodolgy that aims to empower two (or more) sides to reach the best agreement possible which optimizes the central needs of all parties. Unlike arbitration, the core component of mediation is that whether an agreement is reached, it is still 100% determined by the parties themselves rather than being imposed by a third party or a judgment by the court system. This allows invested individuals to maintain an aspect of control while fruitful discussions are lead by a neutral party. The disputants may involve states, organizations, communities, individuals or other representatives with a vested interest in the conclusion.

Since impartially is key for this process, all parties must agree to work with a mediator and each must agree to pay an equal percentage of the fee before engaging within a formal mediation.
